BAKKM Photography Terms and Conditions

1. Applicability

These terms and conditions apply to all services offered by BAKKM Photography, including photo tours, photography workshops, private workshops, corporate workshops, and other organized photography activities.

By making a reservation, the participant agrees to these terms and conditions.

2. Reservation

A reservation is final after:

  • The booking by BAKKM Photography has been confirmed;

  • Any deposit has been received.

A reservation is not considered final until the required payment has been received.

3. Payment

Workshops

Unless otherwise agreed, the full amount must be paid within 7 days of booking.

Photography Trips

For photo tours, a deposit of €500 per person is required.

The remaining balance must be paid in full no later than 8 weeks before departure.

If payment is not received on time, BAKKM Photography reserves the right to cancel the booking.

4. Cancellation by the participant

Workshops

  • Up to 30 days before the start date: cancel free of charge.

  • 30 to 14 days before the start date: 25% of the participation fee.

  • 14 to 7 days before the start: 50% of the participation fee.

  • Less than 7 days before the start date or in case of a no-show: 100% of the participation fee.

A participant may send a substitute at no charge, provided that this is notified in writing in advance.

Photography Trips

  • More than 5 months before departure: full refund of the deposit.

  • From 5 months to 8 weeks before departure: the €500 deposit is non-refundable.

  • Within 8 weeks before departure: 50% of the total trip cost.

  • Within 4 weeks before departure: 75% of the total trip cost.

  • Within 14 days before departure or in case of a no-show: 100% of the trip cost.

5. Cancellation by BAKKM Photography

If a workshop or trip is canceled by BAKKM Photography, any participation fees already paid will be refunded in full.

BAKKM Photography is not liable for any expenses already incurred by third parties, such as airline tickets, hotel stays, car rentals, or insurance policies that were not booked through BAKKM Photography.

6. Changes

BAKKM Photography reserves the right to change programs, locations, or times if circumstances so require, such as weather conditions, safety concerns, government measures, or other unforeseen situations.

This does not give rise to any right to compensation or a refund.

7. Weather Conditions

Photography depends on nature and weather conditions.

Rain, wind, fog, cloud cover, or changing light conditions are not grounds for cancellation or a refund. If possible, a suitable alternative program will be offered.

8. Personal Responsibility

Each participant takes part at their own risk.

Participants are responsible for:

  • his or her health;

  • physical fitness;

  • travel documents;

  • travel and cancellation insurance;

  • personal belongings;

  • camera equipment;

  • drones and other equipment.

9. Camera Equipment

BAKKM Photography is not liable for the loss, theft, or damage of cameras, lenses, drones, laptops, or other personal belongings.

We recommend that every participant make sure to properly insure his or her equipment.

10. Safety

During workshops and photo tours, participants must always follow the guide’s instructions.

If BAKKM Photography deems a location or situation to be unsafe, the program may be modified without prior notice.

11. Behavior

Each participant is expected to treat fellow participants, guides, accommodations, nature, and local residents with respect.

In the event of serious, inappropriate, dangerous, or disruptive behavior, participation may be terminated immediately without the right to a refund.

12. Photos and videos

During workshops and trips, photos and videos may be taken for promotional purposes.

If a participant objects to this, they must notify us in writing in advance.

13. Liability

BAKKM Photography organizes its activities with the utmost care.

BAKKM Photography’s liability is limited to direct damages resulting from demonstrable intent or willful recklessness.

BAKKM Photography is not liable for indirect damages, consequential damages, loss of data, loss of profits, or damage to equipment or personal property, to the extent permitted by law.

14. Force Majeure

Force majeure includes, but is not limited to: extreme weather, natural disasters, pandemics, strikes, technical malfunctions, government measures, war, or other circumstances beyond BAKKM Photography’s control.

In such situations, the program may be changed, postponed, or canceled.

15. Privacy

Personal data is used exclusively for the purpose of fulfilling the agreement and is processed in accordance with applicable privacy laws (GDPR). Data will not be disclosed to third parties unless this is necessary for the performance of the booked activity or required by law.

16. Governing Law

All agreements between BAKKM Photography and the participant are governed exclusively by Dutch law.

Any disputes shall be submitted to the competent court in the Netherlands.
